Terms and Conditions of Service

Welcome to ChilometroZero. By using our mobile application (the "App") and related services, you agree to be bound by these Terms and Conditions of Service (the "Terms"). If you do not accept these Terms, please do not complete registration and do not use the App.

1. DESCRIPTION OF THE SERVICE

ChilometroZero is a digital platform acting as a technical intermediary. We provide a virtual space that lets users (farmers, livestock keepers, artisan producers and consumers) publish listings for the sale of local farm and food products, and communicate to arrange collection.

ChilometroZero does not own the goods offered for sale, does not act as seller or buyer, and is not a party to the transaction between users.

2. ROLE AND LIMITATION OF LIABILITY

Because ChilometroZero only provides the technical infrastructure (listing board, map, chat and order management):

a) No warranty on products: we do not guarantee the quality, safety, wholesomeness, lawfulness or actual availability of the products offered, nor the accuracy of the descriptions provided by sellers.

b) Transactions: all purchases, payment terms and collections take place directly and privately between buyer and seller, outside the App. ChilometroZero does not handle payments between buyer and seller and is not liable for non-payment, fraud or defective goods. Sellers who pass the threshold set out in section 6 are charged a service fee on the value of their sales; this concerns the relationship between the seller and ChilometroZero and does not affect the price paid by the buyer.

c) Disputes: any dispute relating to a purchase must be resolved directly between buyer and seller.

d) Meeting in person: products are collected in person. Please use common sense, agree on suitable places, and check the products at the time of collection.

e) To the extent permitted by law, ChilometroZero is not liable for damages arising from disputes between users, from the quality of the products, or from a transaction not being completed.

3. ACCESS REQUIREMENTS

To register you must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.

4. RULES FOR PUBLISHING LISTINGS

Users who register a seller account and publish listings agree to the following rules:

a) Permitted categories: only local farm produce, food and derived products may be published. Listings that are not relevant (for example electronics, books, non-farming clothing) are not allowed.

b) Certifications: labels attesting to specific production methods (organic, local, ethical livestock, free-range pasture) may only be used if the seller holds the corresponding valid legal certifications. Entering false or misleading certifications will result in immediate removal of the listing and possible suspension of the account.

c) Collection points: the seller undertakes to indicate real, safe and accessible collection points.

d) The optional labels selectable in a listing are statements made by the seller: ChilometroZero does not verify or certify them.

5. SELLER OBLIGATIONS

Anyone publishing listings declares that they comply with the rules applicable to the production, storage, labelling and sale of food products, including food safety rules and tax obligations. Responsibility for product compliance lies solely with the seller.

6. SERVICE FEES FOR SELLERS

Publishing listings and using the App are free until the threshold set out below is reached. There are no fixed charges, subscriptions or activation costs.

a) Free threshold: as long as a seller's total sales stay below 1,000 euros within a 90-day period, use of the App is entirely free. The sales counter automatically resets every 90 days if the threshold has not been reached: a seasonal or occasional seller therefore incurs no cost at all.

b) Passing the threshold: when sales reach 1,000 euros within a 90-day period, the seller is notified in the App and asked to register a payment method. From that point the counter no longer resets and shows the total of sales made.

c) Fee: starting from the calendar month following the one in which the threshold was reached, ChilometroZero applies a fee of 3% of the value of that month's sales, plus VAT where applicable. Sales made before the threshold was passed are not subject to any fee.

d) Basis of calculation: the fee is calculated on the value of orders whose collection the seller has confirmed in the App during the month in question. Declined orders, and those the seller reports as not collected, are not included in the calculation. When collection is confirmed the buyer receives a notification and can report any discrepancy by messaging the seller.

e) Invoicing and payment: at the end of each month the amount due is shown in the Billing section of the App, together with the relevant invoice. Payment must be made within 30 days of issue, using the means provided in the App. We remind you of the deadline with a notice when you open the App.

f) Non-payment: if payment has not been made within 30 days of the due date, publishing new listings is suspended until the balance is settled. Listings already published, orders in progress and conversations remain accessible. Suspension does not extinguish the debt.

g) Record of unpaid amounts: the identifying details of sellers with overdue unpaid amounts are retained even if the account is deleted, for the sole purpose of preventing a new account being opened to avoid payment. This processing is described in the Privacy Policy, and the data is deleted once the amount is settled.

h) Changes: any change to the threshold or the rate will be communicated at least 30 days in advance and will apply only to sales made after it takes effect.

7. USER-GENERATED CONTENT

You remain the owner of the content you publish (text, photographs, messages, ratings). By publishing it you grant ChilometroZero a non-exclusive, royalty-free licence, limited to what is necessary to display and distribute it within the App.

8. ZERO TOLERANCE FOR OFFENSIVE CONTENT AND ABUSIVE BEHAVIOUR

Offensive, discriminatory, violent, sexually explicit, defamatory or unlawful content is not allowed, nor is harassment of other users.

Every listing and every user can be reported directly from the App. Reports are reviewed within 24 hours, and content found to be in breach is removed together with the account that published it.

Every user can block another user: blocked users' content disappears from your feeds and they can no longer contact you.

9. GEOLOCATION

The App uses your location to show you the products closest to you. You can deny or revoke location permission at any time from your device settings; in that case you can choose your area manually.

10. SUSPENSION AND DELETION OF THE ACCOUNT

You can delete your account at any time from the Profile section of the App. Deletion permanently removes your profile, published listings, conversations and uploaded photographs. Completed orders remain visible to the other party for the protection of their rights.

ChilometroZero reserves the right to remove listings and to suspend or delete the account of anyone who breaches these Terms or the applicable law, or who receives repeated substantiated reports.

11. CHANGES TO THE TERMS

We may update these Terms. Material changes will be communicated through the App. Continued use of the service after such notice constitutes acceptance of the updated Terms.

12. GOVERNING LAW AND JURISDICTION

These Terms are governed by Italian law. For consumers, the courts of their place of residence or domicile remain competent under the Italian Consumer Code.
